It will be for the purchaser to formalise any such agreement with the owners of No.59.

Boundary

The boundary of this property on the south extends some 2/3 feet to the south of the hedge to the rear. There has been some encroachment on this ground by an adjoining proprietor digging out a grass verge and parking a car without permission on this area. This encroachment has continued recently, despite requests by the sellers that it be discontinued. The sellers have indicated the position of the boundary to the adjoining proprietors, Balgonie Estate, who have not challenged the accuracy of the sellers’ boundary. The sellers believe that the owner of a house on the opposite side of the access to the rear is responsible for the encroachment mentioned, as he needs to establish a wider road in order to provide adequate access to an intended development on his plot. The sellers wish any prospective purchaser to be fully aware of the position.
